Advertising terms and conditions

  1. Your advertisement contents
    1. The owner/advertiser is responsible for ensuring that all content supplied for inclusion on the HolidayBank site is accurate, honest and correct.
    2. HolidayBank accepts no responsibility whatsoever for any inaccuracy or alleged breaches of ownership or contract arising from any material supplied to us for inclusion on this site.
    3. By placing your property information on the HolidayBank site, you agree to indemnify HolidayBank against any costs or claims whatsoever arising from any material supplied.
    4. All material supplied must comply with current UK advertising legislation. In particular, the Consumer Protection Act (1987) and the Trades Descriptions Act (1968). This includes selecting your property to appear in search features on the site – such as 'near beach' or 'suitable for young children' etc.
    5. HolidayBank reserves the right to make any amendments to text, images or searchable descriptions supplied by the owner/advertiser if necessary or at our discretion. HolidayBank will not be liable for any actual or alleged loss resulting from any such amendments.

Note: 'Your advertisement' constitutes all the information supplied about your property as it appears on HolidayBank.

  1. Your photographs
    1. The owner/advertiser must own full copyright for any images supplied or have explicit permission to reproduce them on HolidayBank.
    2. The owner/advertiser agrees to indemnify HolidayBank against all claims or costs resulting from any unlawful use of pictures supplied.
    3. All digital images resulting from the scanning of photographs supplied to HolidayBank become the exclusive copyright of HolidayBank and may not be reproduced without permission.
  2. Keeping your advertisement up to date
    1. It is the responsibility of the owner/advertiser to ensure that any changes to your property/ies are amended on your advertisement, including uploading new images as necessary.
  3. Keeping your availability calendar up to date
    1. It is the responsibility of the owner/advertiser to ensure that each property's availability calendar is kept up to date and that available weeks are clearly indicated. This also applies to inclusion in searchable offers - such as holiday offers or last minute offers.
  4. Links from your advertisement
    1. We do not permit any hypertext links from your property pages to your own website or any third party website. HolidayBank reserves the right to remove advertisements infringing this rule without notice or recompense.
  5. Advising HolidayBank of a change of e-mail or address
    1. It is the responsibility of the owner/advertiser to advise HolidayBank of any change of your e-mail, address or phone number.
  6. The look of your advertisement
    1. The design and layout of all property pages displayed on HolidayBank have been carefully designed to maximise the selling potential of your property. However, we reserve the right to amend the format or functionality of any pages shown on this website without notice should we deem it necessary to further enhance usability.
  7. The position of your advertisement in search results
    1. We cannot guarantee where your property will appear when any relevant search criteria are applied. Results are not shown in ranked order but are randomly selected. If you wish to feature a property on any particular page, please contact us about advertising your property in a Spotlight Position.
  8. Guest book comments
    1. All entries featured in the 'visitor comments' section must be genuine and proof of their accuracy must be provided if requested.
  9. One property per property page
    1. Each property must be featured individually within its own property page. Even if you own several identical-looking properties on the same site, they must each have their own property page created for them.
  10. Property substitutions
    1. If a property that you have been advertising on HolidayBank is withdrawn, do not substitute the details with that of another property. This will result in the immediate removal of your advertisement.
    2. If a holidaymaker has booked a property with you that subsequently becomes unavailable before their holiday begins, it is entirely the responsibility of the owner/advertiser to advise the holidaymaker immediately and give them the option to cancel their booking or accept or alternative accommodation.
  11. HolidayBank cancellation suspension or refusal of your advertisement
    1. HolidayBank reserves the right to cancel or refuse any property advertisement submitted.
    2. If this is due to a breach of our advertising terms and conditions or our terms of use, we will not refund any money to you.
    3. If we receive a substantiated complaint from a holidaymaker relating to the description, condition or availability of your property, we may take the decision to suspend your advertisement until the issue is resolved.
    4. HolidayBank will suspend any property advertisement if the annual advertising subscription has not been renewed within 1 month of the final renewal date.
  12. Withdrawing your properties from HolidayBank
    1. You may remove your property/ies from the HolidayBank site at any time before the end of your subscription period. However, HolidayBank will not refund part or all of any outstanding advertisement subscription paid.
